Uehiro Seminar: Rescuing Responsibility from the Retributivists - Neuroscience, Free Will and Criminal Punishment

Description

Legal punishment as the routine infliction of suffering poses a serious challenge of justification. The challenge becomes more urgent as a number of thinkers argue that the dominant, retributivist answer fails in the light of the findings of neuroscience. In this talk I sketch a general account of retributivist justification of punishment and the basic neuroscientific argument against it. I then explore ways of challenging the argument by modifying the retributivist account of responsibility and desert. I analyze several variations and argue that none are plausible. I conclude by suggesting one way in which the notion of criminal responsibility can be rescued, but at the theoretical cost of changing the grounds of justification. The goal of this seminar is to have open discussions of controversial political and social issues and raise awareness of current world events in an informal setting. Discussions for the first part of each class will focus on current events from that week, while in the second part of class students will discuss a scheduled issue in greater detail. Scheduled issues include the wars in Iraq and Afghanistan, the regulation of marijuana, how our society should punish criminals, genocide in Rwanda and Sudan, discrimination in our society today, the future of social security, whether pornography is sexist, and where we can go from here in the Arab/Israeli Conflict. Discussions will be supplemented by readings, films, and public speakers. This seminar looks at key issues in the historical development and current state of modern American criminal justice, with an emphasis on its relationship to citizenship, nationhood, and race/ethnicity. We begin with a range of perspectives on the rise of what is often called "mass incarceration": how did our current system of criminal punishment take shape, and what role did race play in that process? Part Two takes up a series of case studies, including racial disparities in the administration of the death penalty, enforcement of the drug laws, and the regulation of police investigations. This seminar is made possible through a collaboration between Radius and the Philosophy section of MIT. This course provides an opportunity to explore a wide range of ethical issues through guided discussions that are geared to equip students for ongoing reflection and action. Lectures and discussions with guest faculty, as well as attendance at on-and off-campus events, expose students to ethical problems and resources for addressing them. The course also encourages students to work collaboratively as they clarify their personal and vocational principles.Topics vary each term and reflect the interests of those enrolled. This free course, Lennox Castle Hospital, looks at the history of institutions in the twentieth century, starting with a case study of Lennox Castle Hospital. It tries to make sense of the history of Lennox Castle, and of institutional life in general, through testimony of those who experienced institutions as inmates and as nurses, as well as through Erving Goffman's model of the 'total institution'. It examines the social bases of segregation, the professionalisation of staff in asylums and institutions, and campaigns for change in the treatment of those segregated from society in institutions.
